How is child custody determined in a contested divorce?

Courts use a 'best interests of the child' standard, weighing factors such as each parent's relationship with the child, stability of the home environment, the child's own preferences (depending on age), and any history of domestic violence or substance abuse. Custody can be physical (where the child lives), legal (who makes major decisions), or both, and it can be sole or shared. A family law attorney can help you understand how local courts typically apply these factors.

What is the difference between contested and uncontested divorce?

An uncontested divorce means both spouses agree on all major issues — property division, support, and custody — before filing, which typically lowers costs and time. A contested divorce involves disputes that require negotiation, mediation, or court intervention to resolve. Even in uncontested divorces, having an attorney review the agreement before signing is advisable to protect your long-term interests.

Can a family law attorney help with domestic violence situations?

Yes. Family attorneys regularly assist clients in obtaining emergency protective orders, filing for divorce involving domestic violence, and ensuring custody arrangements prioritize safety. Many jurisdictions have expedited procedures for domestic violence cases. An attorney can advise on both civil protective remedies and how to coordinate with law enforcement if a criminal matter is also involved.
